Controversia a la reforma de la Ley 100 de 1993, Ley 1122 de enero de 2007 Tafur, Luis Alberto Resumen Introducción: En este artículo se analizan los aspectos que contempla la Ley 1122 de 2007 y se comparan con normas existentes y con posibilidades de lograr las metas propuestas. Dirección: La Ley crea la Comisión de Regulación en Salud (CRES) y le asigna al Consejo Nacional de Seguridad Social (CNSSS) funciones de asesoramiento y consultoría que lo hacen inoperante. Esta decisión concentra el poder en el ejecutivo al ser el Presidente de la República quien nombra a los comisionados y hace desaparecer la participación social e institucional. Es positiva la creación de la figura del Defensor del Paciente, aunque no se comparte su sujeción de la Superintendencia Nacional de Salud. Cobertura universal y financiación: Para alcanzar la cobertura universal, la Ley incrementa la cotización al régimen contributivo en 0.5% y el porcentaje del Sistema General de Participaciones que los entes territoriales deben destinar a la afiliación en el Régimen Subsidiado, disminuyendo proporcionalmente el aporte del gobierno nacional. Se afirma que no se alcanzará la cobertura universal al no estar en ninguno de los regímenes la población de 19 a 24 años desempleados, no estudiantes y solteros, que se calcula en 2'000,000 de personas y la población no afiliada al régimen contributivo del nivel III del Sisbén. Se considera positiva la baja a un año en el tiempo de cotización a una EPS a fin de trasladarse a otra, así como la disminución del período de carencia a 26 meses para las enfermedades de tratamiento quirúrgico y las de alto costo. Prestación de servicios: La contratación obligatoria de las EPS del Régimen Subsidiado del 60% de la UPC con las Empresas Sociales del Estado quita el estímulo en la búsqueda de la calidad como factor de competencia. Controversy with Law 100 of 1993 against Law 1122 January 2007 Tafur, Luis Alberto Abstract Introduction: This paper analyzes Law 1122 of 2007 and compares with present rules and possibilities of obtaining proposed goals. Direction: This Law creates the Comisión Reguladora de Salud (CRES) assigning to the Consejo Nacional de Seguridad Social (CNSSS) activities for advising and consultation turning it no operative. This decision gives full power to the executive branch because the President designs the Comissioners and does not take in account the social and institutional participation. A good point is the creation of the Defender of the Patient although does not consider the Superintendencia Nacional de Salud. Universal coverage and financing: With the goal of reaching the national coverage this Law increases the dues to the contributive system in 0.5% and the percentage of the General System of Contributions that different institutions must give to the affiliation to the Regimen Subsidiado, decreasing in proportion the amount giving by the national government. It is said that the national coverage will not be reached because none of different systems, neither population segment of 19 to 24 years old unemployed, students and singles, approximately 2 million people and the population no affiliated to the regimen contributivo, level III of Sisben. It is very positive the decrease to one year the period to be allowed to change EPS, and the decrease of the lack period to 26 months for surgical and high cost diseases. Medical services: The compulsory engagement of EPS from regimen subsidiado of 60% from UPC with ESE, discourage the search for quality as a competence goal.
